JPMorgan to Pay $228 Million to Settle Muni Bid-Rigging Allegations by SEC

JPMorgan Chase & Co. (JPM) agreed to a $228 million settlement on charges it conspired to rig the bidding on investment contracts sold to state and local governments to boost its profits at taxpayer expense.
The agreement ends investigations of the second-largest U.S. bank by the Justice Department, the Securities and Exchange Commission and the attorneys general of 25 states including the District of Columbia, the Justice Department and SEC said today.
Federal investigators have probed for more than four years how banks and financial advisers fixed bids on investment contracts to let them pay governments below-market rates. JPMorgan’s penalties are the largest yet to result from that investigation, which also led to settlements with UBS AG (UBSN) and Bank of America Corp. (BAC), the biggest U.S. bank by assets.
JPMorgan “improperly won bids by entering into secret arrangements with bidding agents to get an illegal ‘last look’ at competitors’ bids,” Robert Khuzami, director of the SEC’s enforcement division, said in a statement. “Municipal issuers and investors didn’t stand a chance against the fraudulent strategies,” he said.
Criminal charges have been brought against 18 finance- industry employees in the past two years, nine of whom have pleaded guilty, including James Hertz, a former JPMorgan banker. Hertz is one of five former workers at the bank who received letters informing them that they are targets of the Justice Department probe, according to regulatory filings.
Wide-Ranging
Court documents filed by prosecutors point to wide-ranging collusion by Wall Street banks, insurance companies and advisers hired by public officials to guide their investments. Papers entered in a case against CDR Financial Products Inc., an advisory firm based in Los Angeles, identified more than a dozen banks and insurers as co-conspirators.
The accord marks the second for JPMorgan arising from its municipal-derivatives business, which sold the investment contracts as well as interest-rate swaps to state and local governments, before the bank shut it down in 2008. In November 2009, the bank entered a $722 million accord with the SEC to end a separate investigation over its sales of derivatives to Jefferson County, Alabama, where its bankers made undisclosed payments to friends of county commissioners to win business.
Settlement Terms
As part of today’s settlement, JPMorgan took responsibility for “illegal, anticompetitive conduct by its former employees,” the Justice Department said. The SEC said the bank neither admitted nor denied claims in the agency’s complaint.
The accord includes $92 million for the states and the district, $35 million for the U.S. Office of the Comptroller of the Currency, $51.2 million for the SEC and $50 million for the Internal Revenue Service. The agreement with the states provides for $17 million of payments in connection with the federal settlement. JPMorgan said the deal will lead to $211.2 million in net payments.
The bank “doesn’t tolerate anticompetitive activity or other violations of law,” JPMorgan said in the statement. “The firm assisted the government agencies in their investigations and is pleased to have resolved this matter with its regulators,” the bank said.
JPMorgan has increased the number of legal and compliance staff in its public-finance division and raised the level of auditing, said Jennifer Zuccarelli, a spokeswoman. The bank also has increased antitrust, ethics and other training, she said.
Shares Climb
The New York-based bank rose 76 cents, or 1.9 percent, today on the New York Stock Exchange. The shares have gained 8.3 percent in the past year.
The investment contracts at the center of the charges are purchased by states and cities with proceeds of money raised in the $2.9 trillion municipal bond market, allowing them to earn a return until the cash is needed for public works projects.
While competitive bidding is meant to ensure local governments get market rates on their investments, prosecutors say bankers and brokers carved up the market among themselves. Federal prosecutors say that inflated their earnings at the expense wholesale ipad of taxpayers and the Treasury, which collects levies on investment earnings from tax-exempt bond proceeds.
The investigation is continuing and may result in additional charges and settlements. To settle similar cases, Charlotte, North Carolina-based Bank of America in December agreed to pay $137 million, and Zurich-based UBS agreed to pay $160 million in May.
‘Full Pipeline’
“We have a pretty full pipeline on post-crisis cases,” SEC Chairman Mary Schapiro said today in an interview. “So I think hopefully we’ll see some more activity.”
JPMorgan’s misconduct ranged from 1997 to 2005, the SEC said. The agency’s charges say bankers there received tips from brokers that enabled them to win deals, or adjust their bids to make them more profitable, and then lied to cover their tracks. The bank also submitted sham offers in auctions that were won by rivals to give the appearance of competitive bidding.
The SEC said at least 11 different bidding agents, who ran the auctions, also participated, and JPMorgan steered work to those firms in return.
The conspiracy spanned at least 93 transactions related to the proceeds of more than $14.3 billion raised by borrowers in 31 states, the SEC said in its complaint. The agency said the trades produced “millions of dollars in ill-gotten gains.”
The settlement will provide cash to municipalities victimized in the scheme.
Among them are the Pennsylvania Intergovernmental Cooperation Authority, which will get about $3.32 million, and Philadelphia, in line for almost $1.38 million; Chicago, which will get about $1.32 million. The Orlando, Florida, airport authority will receive more than $853,700, according to the agreement between JPMorgan and the U.S. Comptroller’s office.

    Viacom sues Cablevision over iPad streaming

    The lawsuit was filed on Thursday in Manhattan federal court, one day after court documents showed that Cablevision's larger rival Time Warner Cable Inc and Viacom are trying to settle a similar dispute, and have put related lawsuits on hold while they try.
    Viacom said Cablevision's April 2 launch of Optimum App, a computer application to allow streaming of television programs through a cable modem to wholesale  iPad tablets, violates its agreement to distribute Viacom programing only on cable TV systems.
    The popularity of mobile devices such as iPads has caused friction between content providers and cable companies such as Viacom over whether various means of distribution violate contractual or trademark rights.
    Viacom's lawsuit seeks a halt to Cablevision's alleged improper streaming, $2 million for each trademark violation, compensatory and punitive damages, and other remedies.
    Jim Maiella, a Cablevision spokesman, said the Optimum App "falls within our existing cable television licensing agreements with programmers, including Viacom."
    Cablevision is based in Bethpage, New York, and has about 3.7 million customers, a regulatory filing shows. Time Warner Cable has about 14.5 million customers, another filing shows.
    Viacom, whose chief executive is Philippe Dauman and executive chairman is Sumner Redstone, is based in New York. Its channels include MTV, VH1, Nickelodeon, Black Entertainment Television, Comedy Central and Country Music Television.
    Cablevision also owns properties such as the Long Island, New York, newspaper Newsday. Its chief executive, James Dolan, is also executive chairman of Madison Square Garden Co, which controls the New York Rangers hockey team, New York Knicks basketball team and Radio City Music Hall.
    In afternoon trading, Cablevision shares were down 84 cents, or 2.4 percent, at $34.52, while Viacom's Class B shares were down 91 cents, or 1.9 percent, at $47.74.
    The case is Viacom International Inc et al v. Cablevision Systems Corp et al, U.S. District Court, Southern District of New York, No. 11-04265.

    Yahoo Chairman Backs CEO Bartz, but Investor Wants Her out

    Yahoo CEO Carol Bartz was backed by the company's chairman at the start of the company's annual shareholder meeting on Thursday, but got ripped by an investor who called for her resignation.
    Yahoo's board is rumored to be talking to possible CEO replacements, but Roy Bostock said no such thing is in the works and that Bartz has the confidence of the directors because under her guidance, Yahoo has made "demonstrable progress."
    "We still have a lot of work to do to deliver the kind of value we want to deliver to our shareholders. This is indeed a work in progress but this management team has built a strong foundation," Bostock said.
    However, wholesale cellphone an investor, who said he also advises institutional investors with large stakes in the company, blasted Bartz for a variety of things, including the company's stock price, its latest conflict with Alibaba Group and its overall market strategy.
    At this point, Bartz should resign, he said. "The last thing Yahoo needs right now is a lame-duck CEO. The buyout talks over your contract need to start today and a search needs to be accelerated."
    The shareholder spoke for several minutes and didn't mince words in his criticism of Bartz, saying that the upbeat tone of her prepared remarks at the meeting painted an unrealistic picture of what he considers to be a deeply troubled company.
    "No more excuses, no more victory laps," he said.
    When he was finished speaking, she thanked him and said: "That was certainly a downer." The meeting ended on that note.
    All Yahoo directors, including Bartz, won re-election to the board at the meeting. Bartz's CEO contract ends in January 2013.
    In May, Yahoo got into its latest tussle with Alibaba Group, the Chinese company in charge of Yahoo's brand and services in that country. Yahoo owns a 43 percent stake in Alibaba Group worth about US$2.3 billion.
    Yahoo accused Alibaba Group of spinning off its Alipay online payment unit to a Chinese company controlled by Alibaba CEO Jack Ma without Yahoo's knowledge.
    Alibaba countered, saying that it had kept Yahoo's board members informed about the situation, which was driven by new regulations requiring that for Alipay to obtain a license, it needed to be spun off.
    Eventually, the companies issued a joint statement saying they were working to draft a solution to the issue. This week they issued another statement reiterating that discussions are continuing. Yahoo is seeking compensation for the diminished value of its stake in Alibaba Group now that Alipay is no longer part of it.
    Another difficult situation for Bartz is the search partnership she brokered with Microsoft, which isn't yielding the expected revenue for Yahoo so far.
    She has said that the situation should be remedied by year's end and that in the meantime Yahoo is guaranteed a fixed revenue level through March of next year.
    Yahoo has outsourced back-end search functions to Microsoft, like Web crawling, indexing and ranking, to save money and better compete against Google, and in exchange agreed to pay Microsoft a commission for paid search ads sold on Yahoo and Yahoo partner sites.
    When the deal was signed, Yahoo estimated that, when fully implemented, it would boost its annual operating income by about $500 million, provide capital expenditure savings of about $200 million and increase annual operating cash flow by about $275 million.
    On Thursday Bartz, who took over as CEO in January 2009 from co-founder Jerry Yang, rattled off a list of what she considers her main accomplishments, as she has done recently at other meetings and conference calls.
    Specifically, she highlighted the revamping of the company's technology back end, designed to bring global consistency and increase the efficacy of the systems that power Yahoo's content management and advertising platforms.
    With these new systems in place, Yahoo is able to serve up more personalized content faster across its sites, and deliver more targeted and effective advertising.
    She also highlighted Yahoo's focus on delivering its content and ads across all devices and platforms, not only on desktop browsers, and stressed Yahoo's leading position in the U.S. and abroad in content categories like news and finance.
    Still, the company's stock price hasn't rebounded dramatically. Company shares, which closed at $12.10 per share on Jan. 13, 2009, her first day as CEO, stood at $15.23 at yesterday's closing and were trading below $15 during Thursday's meeting.
    In her first quarter on board, 2009's first quarter, Yahoo had revenue of $1.58 billion, down 13 percent year on year, while GAAP net income fell 78 percent to $118 million.
    By comparison, in the first quarter of 2011, Yahoo had revenue of $1.21 billion, down 24 percent year on year, while net income fell 28 percent to $223 million.

    Apple's Tim Cook Visits China Mobile to Discuss 4G LTE iPhone

    Apple Chief Operating Officer Tim Cook is spotted at China Mobile headquarters this morning. A Chinese reporter from First Financial Daily (one of the most prosperous financial papers in China) managed to take a picture of Tim Cook walking in the lobby of China Mobile’s HQ, and there are 7-8 people walking along with Cook. And Cook seemed to be happy.
    Here’s what the reporter posted to her Sina microblog this evening:

    “This morning, around 10, Apple COO Tim Cook is spotted in the lobby of China Mobile’s HQ, accompanied by 7-8 people. Probably Cook is talking with executives from China Mobile to discuss bilateral cooperation for the iPhone. Both China and America flags are seen in the lobby, and Cook seems to be happy.”

    Previously, China Mobile, the country’s largest wireless operator, confirmed that it had “reached consensus” with Apple related to support for their fourth-generation TD-LTE radio technology in future iPhones. China Mobile CEO Wang Jianzhou told MarketWatch that his company will begin commercial trials of the 4G TD-LTE technology next year, but refused to provide a time-frame for a possible 4G LTE iPhone launch in the country. With today’s update on Tim Cook visiting China Mobile, we think the cooperation between China Mobile and Apple will be HUGE. If Apple is going to use TD-LTE in the next iPhone you can bet your arse that every carrier in the world will be making sure their “4G” will be TD-LTE too when it gets deployed. So, does this tell us that an iPhone 5 with 4G LTE support is coming soon?

    That Apple Television Is Coming This August Alongside The iPhone Nano (And Santa)

    I really wanted to do the headline without the Santa bit, but I didn’t want to be that much of an ass.
    Regardless, let’s see how many people report this as fact just from the headline. In other words, let’s catch who doesn’t bother reading beyond the headline — or even the entire headline. In other words, let’s see who is an idiot that should be fired or stripped of their right to blog.
    But wait, my headline does have a point beyond being a (weak) trap. My point is that if you believe an Apple Television is coming later this year, I have a nice iPhone nano to sell you. Catch my drift yet?
    Earlier today, DailyTech reported that Apple would enter the television business later this year. No, they do not mean the business Apple is already in with the Apple TV, they mean the actual television business. As in, there will be a full Apple television set. DailyTech cites a source which they say is a “former Apple executive” who wanted “anonymity” but apparently didn’t mind being cited as a “former Apple executive” even though there aren’t many — and even fewer who would have any clue about this type of recent high level project. But I digress…
    The key information from their source is that an Apple television is due this fall, it is meant to “blow Netflix and those other guys away”, there will be an OEM partner who actually makes the device (DailyTech predicts Samsung), and then Apple will re-brand it as their own and sell it in their stores.
    Where to begin?
    Admittedly, I don’t have much on this information beyond common sense. But that doesn’t mean I have no knowledge either. With that in mind, I don’t have any problem going out on a limb and saying this isn’t happening.
    The Apple-made television set debate is one that has been going on for ages. There are plenty of people on both sides of why it would or would not make sense for Apple to get into this business. I’m actually on the side that believes that Apple will eventually get into this business. I think that for two simple reasons: 1) the potential (meaning mainly the living room) is huge 2) the industry (meaning mainly the television hardware business — including cable boxes) is very ripe for disruption. And even though extremely low margins dominate right now, I think Apple could figure out a way to sell their own televisions at their standard high margins.
    Still, I just can’t see anyway that this happens this fall. Hell, I’d bet it would be unlikely for next fall too. Why? Because I’ve heard Apple has been pleasantly surprised by the moderate success of the newer $99 Apple TV which was released last year. It remains a hobby, but it’s becoming a more interesting hobby for them. And I think they intend to see what they can do with this product that has a relatively low barrier to entry and constitutes little risk for them.
    We’re going to see some interesting things later this year when iOS 5 allows iOS apps to be mirrored to the Apple TV wirelessly. Step two is getting the apps running on the Apple TV itself. Remember, the new Apple TV also runs on iOS — there’s a reason for that. There will eventually be apps on the device.
    I believe that happens before Apple tries their hand at making an actual television set. This will also buy Apple some time as component prices for the large screens needed for modern television sets continue to come down. Right now, the largest screen devices Apple makes are the 27-inch iMacs and Cinema Displays. They’re huge and beautiful — they’re bigger than my TV in college. But they’re not big enough to replace today’s living room TV sets. Apple needs to get to those sizes, and I think they will eventually, but it will take time.
    The biggest problem I have with the DailyTech report is the notion that Apple would partner with an OEM to make the television sets. I have no doubt that some OEMs would kill to get Apple branding on their products. But Apple would never go for that. Apple’s entire essence is about being in complete control of their products. From concept to design to production to software to finished product, they control it all. Apple has ventured a bit outside of this strict creed a bit before. And we got the Motorola ROKR — a piece of crap.
    If Apple does a television set, they’re going to make it. From concept to manufacturing to shipped product, it will be an Apple television.
    The one interesting aspect of the DailyTech report is the notion that Apple is building this television to blow away Netflix. From what I’ve heard, Netflix is something that definitely intrigues Apple. As in, they may view it as perhaps the one online video model that works long-term. Obviously, the two sides have a deal to put Netflix on the Apple TV. And Netflix makes iOS apps. But I wouldn’t be surprised if Apple is thinking about their own solution in this space for future devices down the road.
    While we’re on the topic of Apple rumors, why not briefly address a few others that have popped up today? Earlier, BGR reported that the iPhone 5 may hit in August. From what I’ve heard, this is unlikely. Apple has stated that iOS 5 is due this fall, August is not the fall, and there is no way Apple releases the iPhone 5 without iOS 5. September is looking more likely for each, as we have previously reported.
    A report later this evening by Bloomberg also reiterates September and goes over much of what has already been rumored about the next generation iPhone for some time: better processor, better camera, resembles iPhone 4, etc.
    The more interesting tidbit in this report is that Apple is testing a new iPad with a higher-resolution screen. Back in February, we noted that Apple was lining up for a fall “surprise” and had heard that a new version of the iPad was set to be that surprise. We haven’t heard any new information since then, but it’s still certainly a possibility. Of course, at the time, it wasn’t yet clear that the iPhone 5/iOS 5 would be pushed to the fall. As always, things are fluid. But if I were a betting man, I’d say a new iPad this fall is a better bet than an actual Apple television.

    Yahoo’s 360 Degree Turnaround

    Oof, Yahoo. The Alibaba dispute, just the most recent Yahoo trainwreck, is still a fresh wound for shareholders. And things are getting worse.
    Yahoo CEO Carol Bartz has long promised a turnaround at the lagging company. But we’ve been digging for new information about the state of Yahoo in advance of the annual shareholder meeting later this week, and everything we’re hearing isn’t good. One investor we spoke with said “It’s a turnaround alright, but it’s a 360° turnaround. Basically, they’re spinning in circles.”
    Things we’ve learned from multiple sources:
    - Yahoo is quietly looking at replacement CEO candidates. Fox Digital Chief Jon Miller has had “early and unofficial” discussions with the Yahoo board of directors about taking over as CEO. It’s thought that Yahoo board member David Kenny, who’s long wanted the job, is also a current candidate. Other names have been whispered. Bartz may know that there’s an active if unofficial search going on, but only if she’s hearing it indirectly, says one source.
    - Prabhakar Raghavan, previously head of Yahoo Research, was promoted to Chief Strategy Officer. He is “responsible for developing the long-term corporate strategy and technical vision for Yahoo.” His lack of business experience has alarmed some investors, who see it as a poor judgement call by Bartz.
    - Worst of all, Yahoo’s financial results are said to be significantly below what the street expects, even after expectations were lowered in May. We expect significant revisions to the guidance Yahoo will be giving analysts going forward based on what we’ve heard, particularly for the last half of the year. Even so, the stock price may not drop much. “Investors have already priced the main Yahoo business to zero,” said one investor.
    - Chairman Roy Bostock seems to be the main target of upset shareholders right now. It would be too disruptive to remove Bartz from the board of directors, our sources say, but sending a clear message that they don’t support Bostock would be appropriate. There’s little chance of him actually getting less than a 50% vote, and Yahoo can override a shareholder vote anyway. But if 25% or more of the votes are withheld, it’s likely he’ll be forced to step down. Of course, we’ve seen this movie before and Bostock has survived.
    One person we spoke with was willing to go on record. Eric Jackson, who’s been openly critical of Yahoo for years, said he hopes for a board level shakeup at the meeting on June 23. As for Bartz, Jackson threw this zinger: “Personally I’d like to see [Softbank CEO] Masayoshi Son or [Alibaba founder] Jack Ma become CEO of Yahoo.”
    These are really just the raw notes from our discussions. We have a couple of other major stories developing around Yahoo as well. But for now we just have to wait and see how things play out at the shareholder meeting, and whether the Yahoo board can avoid a massive no confidence vote.

    We knew that July 7 was going to mark the beginning of something after Verizon extended out the free 4G hotspot promo one more time to the 6th, but what we weren’t 100% sure of was if it would have to do with tiered data.  Employees have been receiving training over the last couple of weeks on a new point-of-sale system along with new account management tools that hinted at family plan changes, so again, we knew that something was definitely on the horizon, just weren’t sure exactly what.  Well, we’ve just received word that tiers are scheduled to start the day after the promo ends (on the 7th) for new customers and will look something like this… 
    Data plans:
    2GB – $30/month
    5GB – $50/month
    10GB – $80/month
    If you would like to add tethering on to any of those packages, you can purchase 2GB of data at an additional cost of $20 per month.
    Data plans w/ tethering:
    4GB – $50/month
    7GB – $70/month
    12GB – $100/month
    If you go over your purchased amount of data, it will cost you $10 per 1GB.
    Tablet data plans will now go to $30 for 2GB of data as well instead of $20 for 1GB of data that is currently available.

  • *Note 1 – We have also been told that this is for both 3G and 4G smartphones and that there are not separate plans depending on device.  So if you are under contract currently, you should be fine and don’t need to run out and buy a 4G phone just to lock in as we’ve seen other sites seem to want to suggest.
    *Note 2 - And I should probably clarify that these new prices should not affect anyone that is currently under contract.  Major changes like this concern only new customers and possibly those that are up for a renewal.  We have even heard mention of current customers being allowed to upgrade to a new device after July 7 though, and continue to keep their unlimited data, but are awaiting further clarification on that.

    So far only elation, not border war, from neighbors over Apple mega-campus

    The humongous Apple (AAPL) mother ship campus will one day call Cupertino home, but it'll sit so close to Sunnyvale and Santa Clara that residents there will be able to look out their windows and catch a glimpse of Steve Jobs heading to work -- along with 12,000 other employees.
    But the tech giant's pure economic prowess, with its potential to raise nearby property values and bring good jobs to the region, is easing -- for now, at least -- the typical NIMBY-like disputes and border wars that have plagued these cities in the past.
    So even though Cupertino will soak up the worldwide prestige and millions of dollars in tax revenues, Sunnyvale and Santa Clara are not raising alarm yet about the extra traffic, noise and other suburban headaches sure to be buzzing around their borders.
    Sunnyvale resident David Cookson -- who has for the past 18 years lived across the street from the 155-acre site of the forthcoming campus, now occupied by HP -- says he isn't thrilled about the extra commotion sure to cook up from the iSpaceship sizzling less than 100 feet away from his doorstep. But he's more than willing to overlook those bothers if it means he can drink in the successes of a campus he joked is destined to become "the eighth wonder

    "A project like that, how could you say no?" said Cookson.
    Sunnyvale Mayor Melinda Hamilton and Santa Clara Mayor Jamie Matthews say that even with their cities having no control over the project or direct tax benefit from the giant building, they'll be riding the Apple wave all the way to the bank.
    "There will be people who want to buy homes here, to eat lunch, and we're right on the border," Hamilton said. "Proximity is a huge deal. Having more and better jobs brings the whole region up. That success breeds success."
    No border war yet
    It's a departure in many ways from the relationship between the three cities, which hasn't always been harmonious.
    So many big projects were being built near the border without the consent of neighbors that officials from the three cities and Mountain View held a collaboration summit in 2008 to strengthen ties and soothe old wounds. Then, Sunnyvale's City Council last year passed a resolution that would have required any projects within 1,000 feet of either side of the Sunnyvale border to get approval from both Sunnyvale and the neighboring city, but no other cities agreed to the deal.
    And now, some locals on the other side of the border, like Hamilton, have been dismayed over Santa Clara's plan to build a 49ers stadium sure to jam traffic in other cities. It comes on the heels of border wars that erupted over proposed expansions on opposite sides of the Apple site, at Santa Clara's Kaiser hospital and Cupertino's 99 Ranch Market shopping center.
    There have also been cross-city fights in recent years over a massive mixed-use project slated for the Kohl's site in Santa Clara and the infamous case of a Sunnyvale couple that was forced to trim their redwood trees when their neighbor, in Santa Clara, cited an obscure state law requiring there be sunlight for his solar panels.
    When it comes to Apple's campus, Cupertino leaders have already rolled out the red carpet for Jobs, while their neighbors are viewing the campus with "clear eyes," as Hamilton put it.
    "In Sunnyvale, we make decisions on projects like this after asking the residents how they feel about it, as opposed to declaring 'there's no way we're not going to approve this,' " said Sunnyvale Councilman Chris Moylan, clearly aggravated at Cupertino Mayor Gilbert Wong's comments that Cupertino would never reject Apple's plans.
    Wong, for his part, now says "Apple won't be getting any special treatment." He downplayed many of the impacts the project will have on its neighbors.
    "It's going to be like an urban forest with a building right in the middle of this forest," Wong said. "You have a little bit of inconvenience with the traffic, but I think it's worth it because you can live, work and play within a 10-minute radius."
    Will support last?
    The seemingly unilateral support for the Apple project may not last forever.
    Whether it's the 49ers stadium project, the state's high-speed rail line or almost any other mega construction plan, criticism typically mounts as more details are released. In the case of Apple's campus, officials from neighboring cities were quick to note it's hard to scrutinize the project when formal plans are still months away from being submitted.
    "A lot of the potential impacts come from how you design a project, how you lay it out," said Santa Clara Councilwoman Jamie McLeod, a planner by day. "A big thing is traffic -- but where are the outlets? Does it impact any flows of traffic? It's hard to (know the impact) at this point."
    In the months that follow, consultants will conduct a full traffic analysis and environmental impact review before construction can start. State law will put the onus on Apple to address any projected community problems, through measures like paying for stop lights to ease traffic jams and planting trees to screen neighbors' views.
    City officials also say it appears a portion of Pruneridge Avenue east of Wolfe Road will need to be eliminated to make room for the campus.
    Eager to get ahead of the plans, managers at all three city halls are already meeting with one another to discuss what the project will mean for the region.
    Matthews, for one, thinks the preconstruction review won't be an obstacle.
    "We'll be innovative and find ways around issues that get raised," the Santa Clara mayor said. "It's quite a boon for Silicon Valley. Either we find ways to continue to grow and accommodate these titans of entrepreneurial venture or we stop being Silicon Valley."

    4G PlayBook launches delayed until fall

    Research In Motion Co-CEO Mike Lazaridis on Thursday revealed that the 4G versions of RIM’s PlayBook tablets will not launch this summer, as the company had previously announced. The delays were mentioned in passing as Lazaridis mentioned how excited he was to be launching 4G PlayBook models this fall. RIM had previously stated that three 4G versions of its PlayBook — an LTE model for Verizon Wireless, a WiMAX model for Sprint, and an HSPA+ model for AT&T — would launch this summer. RIM also noted that the new BlackBerry Bold 9900 / 9930 would be delayed until the end of August. Like the 4G PlayBooks, RIM has said previously that the new Bold would launch this summer.

    Playing video from PC to TV
    Hi there,
    I want to do the opposite to most people - play movies from my PC through my dreambox onto my TV. Please can someone help?
    I have VLC installed and think it should be simple to stream to an http address. I've tried that and configured the Dreambox to look at the same address but no cigar. Does anyone have a simple answer for this problem? dreamboxs

    i like to know the answer too, i havent bought any box yet, but if streaming from pc to 500s is not possible then i might get a box with usb support may be 600s (600s - does it have cooling fan in it?)

    I still can't get it to work... Have asked for some professional assistance and will report back if things go well...
    This works great for me although i spent a lot of time trying to get it to work. In the end i changed image. I was using plijade so i changed to Openpli image downloaded the movieplayer plug in from the plugin menu in the image. On pc makes sure vlc is on and web interface is selected. On dreambox movieplayer.xml make sure the pc ip address is the same as the pc. You can edit movieplayer.xml by using tuxbox commander (plugin) from the dreambox or you can open up a web browser on the pc, key in the ip address of the dreambox, wait for the enigma web interface to load then click on 'stream' on the left hand side then click settings then edit to edit the ip address. As i said i spent ages trying to get this to work but as soon as i changed to Open pli it worked. Hope this helps

    The pro is coming in a few weeks. In the meantime I think there might be a way to do this via VNC. Does anyone have experience in this? I have downloaded the vnc plugin and configured the config file according to the instructions at _http://wiki.tuxbox.org/Plugins:VNCviewer]Plugins:VNCviewer - TuxboxWIKI but I can't get it to do anything. Please help...

    priorities has always been our real life and this is also one reason why it
    took some time for LT6.
    The new image is not dictatorial any more. We have splitted all the LT
    plugins from the base image... so YOU can now use this and that LT plugin or
    not.
    We have a new built in skin for the HD boxes named LT6.HD. We hope, you will
    like it like we do.
    As a note on the skin, we have left rather much PiG in it for dm800 box and
    this might make the skin feel little slow. For future upgrades the dm800
    skin might use less PiG to speed it up. For you who likes PiG and do not
    care about speed you can change the skin to full PiG.
    As you know us, we have again a few new plugins for you.
    The first new plugin is named LT Install Wizard. It will be executed the
    first time you boot our image. You can remove or add any LT plugin inside
    it. After the first boot it will not be shown again on bootup, but you can
    reach it in the system menu again.
    We have also a new plugin that allows you to switch the PiP channel without
    a big patch to DMM's code that some other images are using. After the PiP is
    enabled you can toggle between the main window and PiP with the following
    buttons:
    -New remote control (DM8000): SHIFT+PLAY/PAUSE
    -old remote control: SHIFT+TV
    Some user didn't find their location in our Weatherman plugin, so we created

    dreambox recording Dreambox dm8000 hd

    I am amazed!! just got my dreambox 500s recording on to my computer and i'm able to watch it back on my tv, perfect picture, i am truly amazed, incredible!!! Who needs a dreambox 70** kool stuff!! 
    just a couple of questions: wholesale
    1) how do i make the mute button on the remote become a record button?
    2) i've placed an mp3 and some movies in the movie folder, the mp3 appears on the dreambox but the movies don't and for some reason the mp3 doesn't play, how do i fix this and is it possible to watch these movies through the dreambox on the tv?
    3) is there anyway of changing the quality of the recordings? so that they don't take as much space?

    its all in the idiot guide. some advice, disconnect ur firewall, and when u try and record with the timer chose dvr instead of ngrab or switch. otherwise u should be fine if u follow the idiot guide. by the way did it with gbox and gemini 3.0 i don't know if u've got the same.

    I have a big problem with my Dreambox 500s (clone). wholesaleWhen connected to the dreambox, my router keeps on rebooting constantly which results in loss of image on the tv for 10-15 seconds and very short interruption of internet signal. Anyone faced the same problem? Thanks for your help!

    I am trying to install cccam and I am using Dreamelite BH 13C.

    By information on the net. The esiest way to install cccam is to do it by command
    telnet IP-address and then copy some bin-files. But when I do I must login. How do I know that the username and password is?

    Now that DreamElite downloads are no longer working, a shame as it is the best image out there, how can I instal CCcam 2.14. I have both CCcam in tgz format and the CCcam 2.14.zip. I have tried to copy them to tmp directory for manual instal and telnet, but cannot get it to load correctly. How is it done?
    look for cccam2.14 ipk. you can then send it to the temp folder, then install through ipk installer in software management
    if you have CCcam in tgz format than just ftp it to the temp and than press green in the remote control than press yellow .go to manual install del package
    press ok you will find the file there just press ok . than you are there .
    I found a CCcam.ipk file for Dream Elite, ftp to tmp folder and then pressed green on remote, followed by yellow and then Manual Install Ipk packages. It worked straight away.

    Dreambox dm8000 hd pvr up and running...

    Dreambox 8000 up and running...
    After two weeks of head-scratching, my DB8000 is ready for some action.

    As I'm new to Dreamboxes, initial setup posed many problems, not least the fact that I come straight to the box from a Triple Dragon, and although much of the Linux file system is the same, some of the files are in different sections of the system.

    However, once network and satellite configurations were complete, I tried various images, settling on Nabilosat BH, residing in a USB stick alongside the Pure Flash, courtesy of Barry Allen.

    Quality of picture is excellent, both SD and HD.

    The system uses a Broadcom tuner working into a Broadcom 7405. Channel change is rapid.

    I've retrofitted an internal 500GB Hitachi HDD, and will be looking now for a slimline DVD burner. This will be connected to the USB to eSATA stick provided (cable ready inside).HDD runs cool and sweetly.

    A couple of niggles to get off my chest -

    Overall finish is not as good as my TD - front hinge panel seems rather fragile, and the Dreambox escutcheon fell off

    Also, and more importantly, a tuner blanking plate fell inside onto the mainboard as it was very thinly attached to the back panel(luckily it happened when not powered up )

    I have made other owners aware of this on the DB8000 VIP board.

    As for the high price of this receiver, my Echostar SR8700 cost more than this back in the early 90's. Whether this one justifies the cost, time will tell - I looked at several other boxes costing considerably less, but was not too happy whether full support would be forthcoming over time. At least the Dreambox support is second to none.

    I will post updates on my experiencies with the 8000 as things progress.

    DVD drive now added.
    After much hassle, I now have the DVD burner installed (Slimline Samsung SN-S083A).

    The problem was the cable connection (SATA/power plug) didn't appear to be compatible with my drive. I thought I hadn't the adaptor that plugs into the drive, but stupidly I didn't see it languishing in the carton that the Dreambox came in. Too much of a hurry to get the box up and running

    There is no explanation of fitting the drive in the manual, but after uploading a revised manual (see attachment), all became clear, with mention of the aforementioned adaptor.

    Having recorded to the HDD the BBC HD David Attenborough programme about Darwin, I wanted to burn it to disk, but of course being in HD, it will need to be presumably downscaled to SD. In the DVD Burner application, there is mention of changing the format to a variety of ISO images, but I'm not sure which one to choose. So this is my next task, to get it somehow onto the disk.

    Yes, as far as I'm aware, the Linux fraternity are working on it, so we have to wait awhile. Not that I'm in too much of a hurry, Blu Ray drives are pretty expensive, and there's not enough HD content around to justify it.

    If DRM is ever cracked, the possibility of HD movie transfer to/from your Blu Ray drive would be interesting.

    What is the difference between a DM8000 and a box from a provider

    What is the difference between a DM8000 and a box from a provider (UK)
    My basic question is how I can utilize and what I can get out of having a DM8000 compared to getting a box from a UK provider, such as Sky.

    Apart from the obvious that I can hook the box up with a satellite dish, which is kind of difficult where I live, I have to know of what else cool stuff this can bring.


    How does it work with channels that are encrypted? How can I receive those channels? Can I buy a card at Sky or doesn't such exist any more since the introduction of the Box + channels offers?

    I get the concept of a box that is Linux based and "open" source, but I still fail to see the capabilities receiving wise of the box. Hope someone can help me understand its full potential.

    The standard boxes from Sky UK allow Joe Public access to hundreds of channels without having any technical knowledge whatsoever. You take it out of its delivery carton, connect it up and away you go. Its idiot proof. They all operate the same so one in the Channel UIslands will be set up exactly the same as one in the Shetland Islands.

    A Dreambox / linux receiver is a high end enthusiasts receiver which is infinitely customisable. You can do all sorts of interesting things with them, BUT they take a long time to learn how they work under the bonnet - you dont take one out of its box and get the best out of it until you have spent hundreds of hours delving "under the bonnet", broken it a few times, and fixed it.
    So where can I buy cards that allows me to view encrypted channels?

    Is there like a place that sells cards from different providers so that I have a huge pick? Would be nice to see a "complete" selection of cards.


    Beside that, since we cant talk about cable in this forum, where can I ask cable/terrestrial questions?

    with a Dreambox DM8000 a couple of questions

    My first 2 days with a Dreambox DM8000 + a couple of questions
    The Dreambox DM8000 HD is my fourth satellite receiver since a couple of sat dishes were mounted onto my house in September 2000.

    The first one was a Panasonic Sky digibox (TU-DSB30), which was useful as long as the satellite footprint of BBC TV channels reached my home in south east Norway.

    When the footprint shrunk I bought a Nokia Mediamaster 9802 S. I can't quite remember why I ditched that one for a Topfield TF3000 CoCl, which I've been very happy with, until the advent of HDTV.

    After buying a Panasonic plasma TV (TX-P42V20) in the summer, I started looking around for an HD capable satellite receiver. I'd always been interested in the Dreambox concept, and now was as good a time as any to give it a try. Bought mine from a Danish retailer - quite a bit cheaper than the Norwegian dealers take.

    It arrived on Wednesday, and I let it acclimatise for a day to the ambient temperature. I printed the instruction manual and read it from A to Z (though I do wish somebody could persuade the Dreambox company to hire a professional native English-speaking translator - the syntax is pretty hopeless at times)

    Yesterday, I installed a 1.5GB hard drive, and a DVB-T tuener for terrestial Norwegian channels.

    Connecting the various leads was relatively easy - though the DVI output is very close to the scart outputs, in case you want to use both.

    Turning on the receiver for the first time, I was a bit confused by the flash screen, which started with a symbolic earth image in colour, before turning black and white, while the aspect ratio went through a few of its options. I suppose that's what's supposed to happen.

    I let the introduction wizard take me through the first setup steps. Even managed to get the box connected to the local network too after a couple to tries.

    First mistake: Believe it or not, I was sure I'd connected everything which needed connecting before I started searching for channels.

    After one an a half hours of multiple fruitless searches, I suddenly realized I hadn't connected the cables from the satellite dishes - felt a right twit! That said, I've found that things hardly ever work out of the box, there's always something needing tweeking.

    Here comes what so far has been a bit of an exasperating experience.

    One of the satellite dishes has one LNB pointed at the Astra 2 satellite, 28.something east. The second dish has two LNBs, one pointing at Astra at 19E and the other at Hotbird 13E.

    Since the Topfield only had one tuner, it was connected to the Astra/Hotbird combo.

    But it gave me all the channels I wanted, i.e BBC radio, and free French/German/Italian TV and radio channels.

    So I started doing a channel search. To cut a long story short, I've tried multple combinations starting with single satellite - direct connection, configuring first LNB A (where I thought I'd attached the AstraI/Hotbird combo cable) and progressing to two then four satellites (DiSEqC A/B and DiSEqC A/B/C/D), incorporating LNB B, and tuner DVB-T.

    During these searches the satellites were allotted different ports and entered in different sequences. Sometimes I tried tuner DVB-S/S2 A on its own, sometimes tuner DVB-S/S2 B on its own. Sometimes I reverted to a single satellite on one or the other tuner, etc. etc.

    As I exhausted the possible permutations the number of channels grew. By midnight, I had about 1600 altogether (after roughly 15 separate searches of 20 minutes each, 8 crashes and channel testing via the old Topfield to make sure the cables and satellites worked properly).

    The result?

    I still haven't managed to access crucial (crucial to me anyway) channels such as RAI Radio 3, the German ARD and ZDF radio and TV channels - 3Sat, Bayern Klassik, Das Erste, ZDF Theaterkanal, etc. etc.

    I've also tried manual searches - which I'm used to doing on the old Topfield, entering frequency, SR, Fec etc.).

    So why aren't these channels showing up? What should I have done which I haven't tried already?

    (I might add that I flashed the software this morning with the latest from Dreambox.de. The operation was successful, but made no difference to search success.)

    I'm sure there must be a simple explanation. I don't have a toneburster by the way - that's why I selected the DiSEqC option.

    Grateful, needless to say, for all and any suggestions. I'll also try and answer questions if I know how.
    1. How many downleads have you got?
    2. What are they connected to?
    3. What is your switching arrangement?
    4. Which LNBs are connected to which ports on the switch?

    Once you post the answers to those questions it will be easy to tell you how to configure your tuners.

    Here are the answers (I hope) to your questions

    I have two downleads (if you mean the cables between the LNBs and the receiver).

    One goes from the dual LNB (Hotbird/Astra) setup to tuner A
    The other goes from the single LNB dish (Astra 2) to tuner B
    (I've toggled these around numerous times, but this is the connection at present)

    I don't know what the switching arrangement is. I'm trying to get in touch with the technician who installed them, and I'll get back to you on that. He may have stopped work already - it's minus ten here, not much fun if you're mounting satellite dishes outside!

    I do not have a physical switching box - the leads simply go from the LNBs into the living room. The Topfield, as mentioned, has only one tuner, to which I connected the Hotbird/Astra combo, which was more than enough for my purposes.

    I checked the LNB setting on the Topfield for all three satellites - don't know whether this helps or not.

    The settings are identical on all three satellites apart from their position in the DiSEqc 1.0 sequence.

    LNB frequency: 9750-10600
    LNB Power: On
    22 kHz: Off
    12v: Off
    DiSEqc 1.0 : Astra 2 is no 1 of 4, Astra is no 2 of 4 and Hotbird no 3 of of 4

    Other satellites (like Eutelsat 2F4) are 'disabled' in the DiSEQc 1.0 sequence.

    By the way, I've tried having just one of the LNB cables connected. That should obviate the need of a switch I would imagine. But that doesn't seem to work very well either.
    Hold your horses! I think I've managed to solve the prob. While I was writing the previous answer, I'd put the receiver on search: Tuner A on DiSEqC A/B on Hotbird and Astra, and tuner B on single satellite, Astra 2. Lo and behold, my long lost channels have returned like the prodigal son.

    Pretty certain I did the same search several times yesterday. Still, who's complaining if it works?
    Glad you've sorted the DiSEqC problem out DD. So many combinations with two satellite tuners. I have a 4-way switch to one of the tuners - one port for a motorised dish, others for 19E, 13E and 1W. Other tuner for 28E. So that needed a little time to set up for the various satellites.
    Spoke too soon I'm afraid. In my excitement over seeing the German channels appear (Astra 19E), I didm't notice until I'd finished putting them into their different bouquets that there were no Hotbird channels.

    Just did a rerun, but it took half an hour to find absolutely no channels at all on the Hotbird satellite. Then the Dreambox went into slow motion, with every click of the remote causing the cogs to start rolling up in the left hand corner. A bit like an extremely sluggish computer.

    I've turned the whole thing off at the mains, and shall let it mope for a bit. Perhaps it'll pull itself together.

    But I think you've got a point with the switch thingummy.

    I'll report back later this evening or tomorrow.

    Your tuner settings all look correct.

    What I would recommend doing it get a set of motorised Enigma2 settings, opening them in Dreamboxedit then deleting the satellites that you dont need. Once done FTP them to you DM8000 using Dreamboxedit.
    Looks like I've managed to lose every single channel. I did a factory reset (twice) and went through the setup wizard again. I've done a couple of searches using what I thought were the successful settings from this afternoon - not a single channel found on either Hotbird or Astra (there's nothing on Astra 2 that I want, so I don't if that's not working).

    I'm beginning to wonder whether the LNBs haven't frozen themselves into inaction - but if they have, it would be the first time.

    To World-of-Satellite, many thanks for your suggestion. I don't have motorised LNBs, so there's probably not much point in getting motorised Enigma2 settings, even if I know where to look (which I don't) or how to FTP them to the receiver with Dreamboxedit (which I don't have).

    I've obviously made a major league mistake somewhere along the line, but where and what?

    I'm reverting to my trusty Topfield for the evening. Good job I'm not too busy workwise at present!
    Exactly what my satellite technician suggested on the phone this evening, making sure the sequence is replicated in the Dreambox satellite search parameters. I'd already looked up the DiSEqC sequence in the Topfield setup (posted above), and tried again this evening, swapping the cables so that the Astra 2 went into tuner A. But no joy there either.

    I've had to record something tonight as well, using the Topfield, so there wasn't really much time to look into it anymore.

    I think what I'll do tomorrow is flash the software again (if that's possible), and start all over again. The searches are pretty interminable.

    Happy Xmas everyone!

    Since the audio levels are so low from the analogue RCA outputs at the back of the Dreambox, I've been advised by a friend to copy audio files from the hard drive I've installed in the Dreambox over to a USB stick.

    First, is this possible at all? If it is, how is it done? (Nothing in the manual, I've tried searching this site, and am not happy to be told I have to wait 60 seconds between fruitless searches. Amazing! The search engine found not a single entry mentioning USB either in the thread title or posts.)
    Use filezilla and ftp them from HDD to USB.

It was onlytoday that I was made aware of your response when the message popped in the email intray. I'll certainly give it a try, though I've found an easier way round. See separate posting.
